DOCUMENTS NECESSARY FOR THE PREPARATION OF NOTARIAL ACTS

sale of premises constituting separate property

  • basis of acquiring the property (notarial deed/court decision),
  • land and mortgage register number,
  • revitalisation certificate from the competent municipal/communal office,
  • personal data of the parties, their marital status
  • number of bank account to which the sale price is to be paid,
  • in the case of acquisition with the use of loan funds - a loan agreement for inspection and a certificate of the terms and conditions of the loan granted,

 

sale of a cooperative ownership right to premises

  • a certificate from the housing cooperative on the cooperative ownership right to premises,
  • basis of acquiring the cooperative ownership right to premises (notarial deed/premises allocation certificate),
  • land and mortgage register number, if established,
  • personal data of the parties, their marital status
  • number of bank account to which the sale price is to be paid,
  • in the case of acquisition with the use of loan funds - a loan agreement for inspection and a certificate of the terms and conditions of the loan granted,

disposal of an undeveloped or developed property

  • basis of acquiring the property (notarial deed/court decision),
  • extract from the land register,
  • extract from the land register map, in the case of selling a part of the property from the land and mortgage register,
  • spatial development plan certificate,
  • revitalisation certificate from the competent municipal/communal office,
  • certificate from the District Governor's Office as to whether the plot of land constitutes a forest,
  • additional documents regarding the property, if any, e.g. final building permit, construction log,
  • personal data of the parties, their marital status
  • number of bank account to which the sale price is to be paid,
  • in the case of acquisition with the use of loan funds - a loan agreement for inspection and a certificate of the terms and conditions of the loan granted,

sale of agricultural property

  • basis of acquiring the property (notarial deed/court decision),
  • extract from the land register,
  • extract from the land register map, in the case of selling a part of the property from the land and mortgage register,
  • spatial development plan certificate,
  • revitalisation certificate from the competent municipal/communal office,
  • certificate from the District Governor's Office as to whether the plot of land constitutes a forest,
  • personal data of the parties, their marital status
  • number of bank account to which the sale price is to be paid,

and the following information:

  • Is the buyer the owner, perpetual usufructuary, lessee, owner-like possessor of other agricultural properties? If so, details of such properties (i.e. plot numbers, area, location (commune, district, province), land and mortgage register number),
  • Is the buyer an individual farmer?
    If so, evidence that they:
  • own an agricultural holding,
  • possess agricultural qualifications (years of service + education other than agricultural or agricultural education), in which case, to prove agricultural qualifications – original school certificate, diploma,
  • have lived for 5 years in the municipality where they operate the agricultural holding, in which case, proof of permanent residence indicating the date from which they have been registered.

deed of succession certification

  • an abridged copy of the deceased's death certificate,
  • an abridged copy of the marriage certificate if the deceased was married,
  • abridged copies of marriage certificates (in the case of women with changed surnames), or abridged copies of birth certificates of statutory heirs (children),
  • cancelled identity card of the deceased or, failing that, a certificate of the deceased's PESEL number from the municipal/communal office competent for the last place of residence of the deceased,
  • data from the heirs' identity cards,

and the following information:

  • Has the deceased made a will?
  • Does the inheritance include the ownership of real estate, if so, the land and mortgage register number is needed?
  • Have any of the heirs made a declaration of acceptance or rejection of the succession?
  • Was the deceased an entrepreneur?
  • Does the inheritance include inheritance debts?

developer agreement

  • final building permit along with decisions about modifications and transferring rights from decisions,
  • extracts from the land register and extracts from the land register map for the plot(s) of land on which the development is to be built,
  • certificate on the content or on the absence of the spatial development plan,
  • revitalisation certificate from the competent municipal/communal office,
  • certificate from the District Governor's Office as to whether the plot of land constitutes a forest,
  • basis of acquisition (notarial deed/court decision),
  • open or closed escrow account agreement,
  • site development plan,
  • technical description of the building and premises,
  • information prospectus with attachments (layout of the premises and the floor on which the premises are located),

and the following information:

  • time schedule of construction works (stages after which the developer will be able to receive money from the open escrow accounts),
  • start date of construction works,
  • end date of construction works,
  • date of obtaining the building occupancy permit,
  • date of signing sales agreements,
  • date of handing over the premises (for self-finishing and possession by buyers),
  • information on when the technical acceptance of premises will take place,
  • price per square metre of the premises,
  • situations when the price may increase (change in area, change in finishing works, change in VAT rate, etc.).

extension of marital community of property

  • basis of acquiring the property,

division of joint property

  • basis of acquiring the property,
  • final court judgment in a divorce case or an agreement establishing separation of property,

  • in case the joint property includes undeveloped or developed property:
  • extract from the land register,
  • spatial development plan certificate.
